Acceptance of Terms

By downloading, installing, or using the Whim mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

Whim is an AI-powered chat interface application that enables users to:

• Interact with multiple AI assistants in unified conversations
• Share and discuss Instagram posts through AI analysis
• Connect Instagram accounts for seamless content sharing
• Receive direct messages sent to our business account (@whim.im) within the app

User Accounts and Registration

Account Creation

• You must provide accurate and complete information when creating an account
• You are responsible for maintaining the security of your account credentials
• You must be at least 13 years old to use Whim

Instagram Integration

• Connecting your Instagram account is optional but required for certain features
• You authorize Whim to access shared Instagram content according to our Privacy Policy
• You can disconnect Instagram integration at any time

Acceptable Use Policy

Permitted Uses

• Personal, non-commercial use of the App
• Sharing and discussing content in accordance with these Terms
• Connecting third-party services you own or have permission to connect

Prohibited Activities

You may NOT:

• Use the App for illegal purposes or to violate any laws
• Share content that infringes intellectual property rights
• Attempt to reverse engineer, hack, or compromise the App
• Create fake accounts or misrepresent your identity
• Share harmful, abusive, or inappropriate content
• Spam or send unsolicited messages through our Instagram integration
• Use the App to harass, threaten, or harm others
• Violate Instagram's Terms of Service when using integration features

Content and Intellectual Property

Your Content

• You retain ownership of content you create and share
• You grant Whim a license to process your content to provide our services
• You represent that you have rights to share any content you upload

AI-Generated Content

• AI responses are generated by third-party services (OpenAI, Anthropic, Google)
• AI-generated content is provided "as-is" without warranties
• You are responsible for how you use AI-generated content

Instagram Content

• Shared Instagram posts remain subject to Instagram's terms and the original creator's rights
• We process Instagram content only to provide our forwarding and analysis services

Third-Party Services

AI Providers

• Whim integrates with third-party AI services
• Your messages may be processed by these services according to their terms
• We are not responsible for third-party AI service performance or availability

Instagram Integration

• Instagram integration is subject to Meta's Platform Policy
• Changes to Instagram's API may affect our integration features
• We are not affiliated with or endorsed by Meta/Instagram

Instagram Messaging Features

Business Account Messages

• Messages sent to @whim.im become part of our service
• We forward qualifying messages to connected user accounts
• Message senders consent to this processing by messaging our account

Content Responsibility

• Users are responsible for content they send via Instagram DM
• We reserve the right to filter or block inappropriate messages
• Repeated violations may result in blocking from our Instagram account

Privacy and Data

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using Whim, you consent to our data practices as described in the Privacy Policy.

Limitation of Liability

Service Availability

• Whim is provided "as-is" without warranties of any kind
• We do not guarantee uninterrupted or error-free service
• AI responses may be inaccurate or inappropriate

Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WHIM SHALL NOT BE LIABLE FOR:

• Indirect, incidental, or consequential damages
• Loss of data, profits, or business opportunities
• Damages arising from third-party AI services or Instagram integration
• Any damages exceeding the amount paid for the App (if any)

Termination

Your Rights

• You may delete your account and stop using Whim at any time
• Account deletion will remove your data according to our Privacy Policy

Our Rights

We may suspend or terminate your access if you:

• Violate these Terms or our Acceptable Use Policy
• Engage in harmful or abusive behavior
• Use the App in ways that could damage our service or reputation

Changes to Terms

We may modify these Terms periodically. Material changes will be communicated through:

• In-app notifications
• Email notifications (if provided)
• Updated effective date on this document

Continued use after changes indicates acceptance of modified Terms.

Governing Law and Disputes
